Please read through the eligibility guidelines prior to scheduling your appointment below.

Who We Serve Directly

As the legal service provider for the Undocumented Student Program, the East Bay Community Law Center (EBCLC) provides immigration legal consultations and, as resources and circumstances allow, full legal representation to: 

  • Current UC Berkeley students (undergraduate, graduate, or professional) who are undocumented or who have DACA or Temporary Protected Status (TPS) 
  • Former UC Berkeley students who graduated within the past six months or have withdrawn and intend to return to UC Berkeley, who are undocumented or have DACA or TPS 
  • UC Berkeley alumni (any length of time after graduation) who have previously received immigration legal services from EBCLC and are seeking assistance with a DACA renewal only   

EBCLC reserves the right to amend case acceptance guidelines in light of limited resources.  

 

Who We Serve Indirectly

Due to the high demand for our services by current UC Berkeley students who are undocumented or have DACA or TPS, for the Spring 2024 semester we will refer out family members (spouses, domestic partners, parents, siblings, and children) to trusted legal service providers. 

If the family member: a) lives in California (or formerly lived in California and hopes to return) and b) meets income eligibility requirements.* EBCLC will cover the cost of a legal consultation with a trusted legal service provider.  

In all instances to receive services for family members, the UC Berkeley student who is undocumented or has DACA or TPS must have had a consultation with EBCLC first. This is because in some instances EBCLC takes on representation of family members of UC Berkeley students because it directly and positively impacts the UC Berkeley student’s ability to obtain legal immigration status.  

To request a consultation or services for your family member please contact the EBCLC staff member who conducted your consultation. IF you do not remember who conducted your consultation please e-mail USPLegal@ebclc.org for further guidance. 

*To meet income eligibility requirements for family members and alumni, household income from all sources must be at or below 250 percent of the Federal Poverty Guidelines as published by the U.S. Department of Health and Human Services 

 

Who We Are Unable to Serve

Our program was created to serve undocumented students and, when possible, their family members. Our program is currently unable to provide services to family members of U.S. citizen or Lawful Permanent Resident students, to students or family members with non-temporary immigration statuses, or to international students. However, the EBCLC Immigration Unit can provide referrals to other nonprofit organizations or private attorneys, and may in some cases have capacity to represent noncitizens who are unable to pay for legal representation but do not qualify for services through USP. If you are seeking immigration legal services but are not eligible for a legal appointment through USP, please call the general line for the EBCLC Immigration Unit at (510) 548-4040 ext. 202 and leave a voicemail with your contact information.  A team member will reach out to screen you for services or provide you with appropriate referrals. You can also see the list of referrals that EBCLC provides by visiting http://bit.ly/ImmUnitReferrals. In general, international students will be referred to the Berkeley International Office. 

 

Making Your Appointment

Please read the eligibility guidelines above before making an appointment; your appointment will be cancelled if you are not eligible for services through this program. If you are unsure about whether you or your family member qualify for USP legal services, you may email usplegal@ebclc.org. 

If you believe that you or your family member meet all of the guidelines listed above, please schedule your consultation using this link: https://ebclcimmigrationlegalclinic.as.me/USPLegal.

You can also make any rescheduling requests through the same portal at least 24 hours in advance of your scheduled appointment.

  • Even if you are scheduling an appointment for family member, the UC Berkeley student must be the one to schedule the appointment. The booking form will indicate where to list your and your family member’s information.
  • Please make sure to list the any deadlines (work permit expiration date, status expiration date, hearing dates (criminal or immigration-related, etc.) and include your or your family member’s income where indicated on the booking form. We may have to cancel the consultation if you do not include this information.
  • If there are no available appointments or if you are unable to make an appointment during the allotted times, please feel free to email usplegal@ebclc.org. You can also email this address if you are following up on an existing case. Please allow at least 3 business days for staff to get back to you.
  • Please bring any pertinent immigration paperwork to the appointment so that we can best serve you. After you schedule your appointment online you will receive a confirmation email with more guidance.

All consultations with any USP legal staff are strictly confidential and privileged and all services are conducted or supervised by licensed attorneys.

EBCLC is the legal service provider for USP. As one of the largest providers of free legal services in the East Bay and home to eight of Berkeley Law’s community-based clinics, EBCLC places tremendous importance on the health of our staff, students, clients and the public. We are committed to providing responsive legal services in the areas of housing, health, immigration, education, and economic security, and we will continue to do so with the utmost respect for our clients. All visitors to our offices are required to wear N-95 or KN-95 masks (which are provided), and to complete a COVID-19 questionnaire before entering the office.
